Welcome to BBK Energy Solutions LLC (“BBK Energy,” “BBK,” “we,” “us,” or “our”). These Terms of Use govern your access to and use of our website, online store, forms, payment links, product information, communications, customer service channels, transaction confirmations, and related services (collectively, the “Services”).

By accessing, using, submitting information through, requesting a quote from, communicating with, making a payment to, or purchasing through our Services, you agree to be bound by these Terms of Use. If you do not agree to these Terms, you should not use our Services.

1. COMPANY INFORMATION

BBK Energy Solutions LLC is a Florida limited liability company engaged in energy-related commercial services, including marketing, sales coordination, customer support, order coordination, payment coordination, documentation support, and related activities involving energy products, systems, components, and services.

BBK Energy may act, depending on the transaction, as a seller, commercial coordinator, facilitator, payment coordinator, limited collection agent, or business intermediary in relation to energy-related products or services supplied, provided, delivered, installed, or supported by third parties.

BBK Energy is not a bank, lender, credit union, financial institution, money transmitter, manufacturer, or financing provider.

2. ELIGIBILITY

You must be at least eighteen (18) years of age and legally capable of entering into binding agreements to use our Services.

By using our Services, you represent and warrant that all information you provide is accurate, complete, truthful, and not misleading.

3. PRODUCTS, SERVICES, AND AVAILABILITY

Product descriptions, specifications, pricing, availability, delivery estimates, installation estimates, service information, financing options, and related details are subject to change without notice.

BBK Energy may modify, suspend, cancel, update, or discontinue products, services, offers, payment options, or website features at any time.

Images, product descriptions, performance descriptions, estimated capacities, installation examples, and related content are provided for general informational purposes unless expressly stated otherwise in writing.

4. ORDERS AND PAYMENT CONFIRMATIONS

An order, payment confirmation, receipt, email notice, payment link confirmation, or transaction record may be issued for administrative, operational, accounting, or documentation purposes.

Receipt of a payment confirmation does not necessarily mean that a product has shipped, been delivered, been installed, or that all conditions related to the order have been completed.

Orders may remain subject to verification, payment availability, fraud review, supplier availability, processor review, delivery coordination, installation coordination, cancellation, refund, chargeback, or other applicable conditions.

5. PAYMENTS AND PAYMENT PROCESSORS

BBK Energy may accept payments through Stripe, payment links, cards, Zelle, bank transfers, online checkout, digital invoices, or other authorized payment methods.

Payments processed through third-party providers are subject to the terms, conditions, security practices, fees, settlement rules, fraud review procedures, refund procedures, and processing timelines of those providers.

BBK Energy does not store full credit card numbers on its own systems.

Payment processors, banks, card networks, or financial platforms may delay, hold, reject, reverse, reserve, investigate, or adjust payments. BBK Energy is not responsible for delays or restrictions caused by third-party processors, banks, card networks, payment platforms, or customer financial institutions.

6. FEES, REFUNDS, CHARGEBACKS, AND PAYMENT DISPUTES

Refunds, cancellations, credits, adjustments, or chargeback responses will be handled according to the specific transaction, applicable written terms, payment processor rules, supplier or manufacturer policies, and applicable law.

Certain fees charged by payment processors, card networks, banks, financial platforms, or third-party providers may be non-refundable.

If a customer initiates a payment dispute, chargeback, reversal, or fraud claim, BBK Energy may use transaction records, communications, order confirmations, delivery information, payment records, invoices, settlement records, or other documentation to respond to the dispute.

BBK Energy reserves the right to suspend or cancel an order, hold delivery coordination, request additional verification, or decline future transactions when fraud, suspicious activity, payment risk, repeated disputes, or processor restrictions are identified.

7. THIRD-PARTY PRODUCTS, SUPPLIERS, INSTALLERS, AND SERVICES

Our Services may involve products, components, systems, installation services, logistics services, financing providers, software tools, payment processors, suppliers, manufacturers, contractors, or other third parties.

BBK Energy is not responsible for third-party content, third-party financing decisions, third-party warranties, manufacturer warranties, supplier warranties, installer conduct, logistics delays, third-party service failures, or third-party privacy practices.

Your use of third-party services, financing platforms, payment processors, supplier services, manufacturer warranties, or installer services may be governed by the terms and policies of those third parties.

8. WARRANTIES

Manufacturer warranties, supplier warranties, installer warranties, service warranties, or third-party warranties are governed by the terms established by the applicable manufacturer, supplier, installer, service provider, or warranty provider.

Except as expressly stated in writing by BBK Energy, BBK Energy makes no independent warranty regarding products, product performance, manufacturer warranties, supplier warranties, third-party services, financing approvals, delivery timelines, installation timelines, or third-party performance.

9. CUSTOMER RESPONSIBILITIES

You agree to provide accurate and complete information when submitting forms, requesting quotes, communicating with BBK Energy, making payments, or placing orders.

You are responsible for reviewing product information, transaction details, payment amounts, delivery information, and written terms before completing a transaction.

You agree not to use our Services for fraudulent, unlawful, abusive, misleading, unauthorized, or improper purposes.

10. FINANCING DISCLAIMER

BBK Energy may provide access to financing application platforms, financing-related information, or introductions to independent third-party financing providers.

BBK Energy does not issue loans, make credit decisions, guarantee financing approval, determine financing terms, control underwriting criteria, or act as a lender.

Approval, interest rates, loan amounts, repayment terms, and financing conditions are determined exclusively by the applicable financing provider.

11. ELECTRONIC COMMUNICATIONS

By using our Services, submitting forms, requesting quotes, making payments, or communicating with us electronically, you agree to receive communications electronically.

Electronic notices, agreements, disclosures, invoices, payment links, confirmations, receipts, signatures, transaction records, and other electronic records satisfy any legal requirement that such communications be provided in writing, to the extent permitted by applicable law.

12. PRIVACY

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

By using our Services, you acknowledge that BBK Energy may collect, use, retain, and share information as described in the Privacy Policy.

To the maximum extent permitted by law, BBK Energy shall not be liable for any indirect, incidental, consequential, special, punitive, exemplary, reputational, business interruption, loss of profit, loss of opportunity, loss of data, or similar damages arising out of or relating to:

- Payment processing;

- Financing applications;

- Third-party actions;

- Product delays;

- Supplier delays;

- Manufacturer issues;

- Installation delays;

- Logistics delays;

- Service interruptions;

- Website errors;

- Processor holds, reversals, reserves, or chargebacks;

- Customer-provided inaccurate information.

Nothing in these Terms shall limit liability where such limitation is prohibited by applicable law.

16. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless BBK Energy Solutions LLC, its members, managers, officers, employees, contractors, affiliates, agents, and representatives from any claims, liabilities, damages, losses, costs, expenses, chargebacks, disputes, penalties, or legal fees arising from:

- Your use of the Services;

- Your violation of these Terms;

- Your violation of applicable law;

- Information you provide to BBK Energy;

- Fraudulent, inaccurate, incomplete, misleading, or unauthorized information or activity;

- Payment disputes, chargebacks, or reversals caused by your actions or omissions;

- Your misuse of payment links, forms, communications, or services.

17. COMPLIANCE, FRAUD REVIEW, AND SUSPENSION OF SERVICES

BBK Energy may review, suspend, delay, cancel, or refuse a transaction, order, payment, communication, delivery coordination, or service when it reasonably believes that fraud, suspicious activity, payment risk, regulatory risk, processor restrictions, sanctions issues, inaccurate information, or misuse may be involved.

BBK Energy may also request additional information or documentation before completing a transaction.

18. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles.

19. CHANGES TO THESE TERMS

BBK Energy reserves the right to update, modify, or revise these Terms of Use at any time.

Updated versions will become effective upon posting on our website with a revised “Last Updated” date. Your continued use of the Services after an update means you accept the revised Terms.
